PREAMBULE

Fidal is committed to upholding the principles of personal data protection and undertakes to respect the principles of European regulations vis-à-vis users of its Website.

The purpose of this data protection policy is to inform users of the commitments made and the measures taken by Fidal to ensure that their data are adequately protected.

This policy may change depending on the legal and regulatory environment, as well as the positions taken by the Data Protection Supervisory Authority (Commission Informatique et Libertés).

Personal data processed in relation to the www.fidal.com website is included on the list of processing operations carried out by the Data Protection Officer of FIDAL SELAS.

The Data Controller is FIDAL, SELAS Société d'Avocats, a société d'exercice libéral par actions simplifiée (a simplified joint-stock company formed by self-employed practitioners) with a management board and a supervisory board and a share capital of €6,000,000,000, registered with the Trade and Companies Register under number 525 031 522 R.C.S. Nanterre, whose registered office is at 4.6 avenue d'Alsace, 92982 Paris La Défense Cedex, whose representative is François de Laâge de Meux in his capacity as Chairman of Fidal's Management Board.

COLLECTED DATA AND PURPOSES OF DATA COLLECTION

Fidal’s Website implements a system for the collection and processing of personal data that are shared as and when the user accesses it.

The user's personal data which are collected directly (e. g. when connecting to the customer service center, when sending a question via the contact page or when submitting a résumé via the appropriate form) or indirectly (connection data) are used for specified, explicit and legitimate purposes.

They are used by Fidal:

  • for statistical purposes or;
  • to enrich editorial content and adapt it to users’ needs; or
  • to reply to requests and applications for information on the services offered by Fidal. For this purpose, it may be necessary for Fidal to call the user back by telephone or to communicate with the user by e-mail; or
  • for managing registrations for events organized by Fidal or users' subscriptions to blog publications; or
  • for recruitment purposes. If the user submits a CV or an application on-line, Fidal will use this personal data for recruitment purposes, which may involve Fidal contacting the user by email, telephone or post. In some cases, the user may be asked to register on the Fidal website. Unless you request otherwise, Fidal may keep this personal data on file for a certain length of time in order to possibly contact the user in the future for other employment opportunities at Fidal.

These purposes were brought to the attention of Fidal's Data Protection Officer, who entered them into its data processing register.

The communication of personal data in this context is voluntary. If the user chooses not to provide such personal data, they will not be able to benefit from the relevant services offered by Fidal's websites, such as communication, the downloading documents or recruitment opportunities.

Where users provide personal data on the Fidal website, they certify that they have received the necessary authorizations and consents from the persons concerned by such personal data, if the data are about persons other than themselves and, where applicable, for the uses described in these general conditions of use.

As a general rule, Fidal does not collect sensitive personal data through its website. By voluntarily providing Fidal with sensitive personal data without being asked to (for example by submitting a CV or an on-line application), the user expressly consents to the use of his/her personal data as described in these terms and conditions.

    • collect statistics;

  • whether the answers are mandatory or optional: fields marked with an asterisk are mandatory fields

  • Rights of access, rectification, modification, limitation and erasure of data subjects’ data, their right to object for legitimate reasons, their right to object to the data being used for commercial prospecting purposes and their right to define guidelines on the fate of their personal data after their death.

 

USERS’ RIGHTS

The user has a right to access, change, correct, limit and delete data.

Users also have the right to object to the processing of their personal data for legitimate reasons, as well as a right to object to the use of their data for commercial canvassing purposes.

Finally, data subjects have the right to define general and specific guidelines that set out the manner in which they intend to exercise these rights after their death.

Users are, in any case, entitled to lodge a complaint with the CNIL.

DATA RECIPIENTS

Fidal’s relevant departments are the recipients of your personal data.

These personal data will not be communicated to third parties except to external technical service providers who act to disseminate the Site contents. It is Fidal's policy to ask these external service providers to process personal data in accordance with Fidal's privacy and security undertakings.

 

DATA RETENTION

Fidal will keep its users' personal data only for the time necessary to process them for the purposes for which they were collected and in compliance with the regulations in force. Thus, data relating to customers are kept for the duration of the contractual relationship, increased by three (3) years for the purposes of facilitation and prospecting, without prejudice to retention obligations or limitation periods.

Data relating to prospects are kept for a period of three (3) years from their last incoming contact with the firm.

Résumés are kept for two (2) years as of the last contact with the job applicant.

 

SECURITY

Fidal shall ensure the security of your personal data by implementing enhanced data protection through the use of physical and logical security measures.

Fidal has implemented a policy to protect personal data against loss, misuse, alteration or destruction. Any Fidal member who accesses this information is informed of its confidential nature. In addition, Fidal ensures that its technical service providers who may have access to personal data abide by the same obligation of confidentiality.

However, users should be aware that since the Internet is open to all and is not secure, Fidal cannot be held responsible for the security of personal data transmitted over the Internet.

Definition
