Strait of Hormuz: Legal Implications of a Geopolitical Blockade

Against a backdrop of mounting international tensions, the Strait of Hormuz blockade highlights major legal and economic challenges for global trade stakeholders.

Jalal El Ahdab, a partner in Fidal’s International Arbitration and Dispute Resolution team, was interviewed by Anne Portmann for LJA (La Lettre des Juristes d’Affaires) to analyze the legal framework surrounding this situation.

In this interview, he emphasizes that this crisis is part of a broader trend of geopolitical escalation and deglobalization, while raising the question of the legal status of strategic straits.

He also highlights:

•    the systemic repercussions of the blockade on numerous sectors (energy, agriculture, transportation, industry), beyond oil alone;
•    the complex legal issues, particularly regarding liability, right of passage, and compliance in the face of international sanctions;
•    the contractual challenges for companies (force majeure, insurance, risk allocation) in a context of heightened uncertainty; and
•    how organizations are adapting, with a growing focus on geopolitical risks in their strategies.
