Privacy policy applicable to users of the Website and/or the Recruitment Website

Aware of the importance of protecting privacy and individual liberties, FIDAL SELAS Law Firm (hereinafter, "Fidal" or "We") undertakes to ensure their protection in accordance with applicable law and in particular with Regulation (EU) 2016/679 of 27 April 2016 and French Law No. 78-17 of 6 January 1978 as amended (hereinafter together, the "Regulations"). 

The purpose of this privacy policy is to inform you of the principles governing how we process your personal data in connection with our websites accessible from www.fidal.com (hereinafter, the "Website") and www.recrutement.fidal.com (hereinafter, the "Recruitment Website") and of the rights you have in respect of your personal data. 

  1. Who is the data controller of my personal data?

The data controller is Fidal SELAS Law Firm, a professional corporation with an executive committee and supervisory board, registered with the Nanterre Trade and Companies Register under no. 525 031 522, whose registered office is located at 4-6 Avenue d'Alsace, 92400 COURBEVOIE, FRANCE.

Fidal has appointed a Data Protection Officer (DPO). If you have any questions concerning the processing of your personal data, you can contact the DPO:

  1. What personal data does Fidal collect and process?

In accordance with the principle of "data minimization," we endeavor to collect and use only data that is relevant and strictly necessary for the processing purposes. 

When you use the Website, Fidal may collect the following categories of data:

  • Identification data: your first and last name, your job title (if applicable), the company you represent (if applicable); 

  • Contact details: your postal address, your e-mail address.

In addition, the information contained in the contact requests you may send us from the Website may constitute personal data. In this respect, Fidal may also collect and process personal data according to the information contained in your contact requests. 

When you use the Recruitment Website, Fidal may collect the following categories of data:

  • Identification data: your title, first and last name, e-mail address; 

  • Data about your training: your level of education, certificate of aptitude for the legal profession (optional), year in which you obtained your certificate of aptitude for the legal profession (optional)

  • Data about your professional experience: level of experience, management role (optional), size of team managed (optional); 

  • Data about your language skills: language spoken (optional), language level (optional);

  • Data about opportunities that may be of interest to you: type of contract sought, profession sought, specialty, area(s) of mobility; 

  • Data about your application: data contained in your CV, data contained in your cover letter (optional), data contained in any other documents sent from the Recruitment Website (optional), source of your application. 

Lastly, it should be noted that, depending on the information contained in the requests you send us from the Website and/or the requests and/or documents you send us from the Recruitment Website, Fidal may collect and process so-called "sensitive" data.

In the context of your use of the Website and/or the Recruitment Website, Fidal may process your personal data for the following purposes and on the following legal bases:

  1. To whom is my personal data transmitted? 

Within Fidal, only those persons authorized to do so by virtue of their duties or functions may access the personal data processed, and only within the strict limits of their respective responsibilities and of the performance those duties and functions. 

Your personal data may be communicated to our data processors (e.g. third parties performing hosting, management and IT maintenance services for our websites or contact management (CRM) services), in strict consideration of the intended purposes and only insofar as is necessary for them to fulfil their tasks. 

  1. Is my personal data transferred to countries outside the European Union?

We do not transfer your personal data outside the European Union, as it is stored exclusively within the European Union. 

  1. How long do you keep my personal data? 

Your personal data will be kept in a form that allows you to be identified for no longer than is necessary for the purposes for which it is processed.

Personal data relating to clients is kept for the duration of our contractual relationship, plus three (3) years for promotional and direct marketing purposes, without prejudice to any applicable recordkeeping obligations or limitation periods. 

Personal data relating to prospects is kept for a period of three (3) years from the last contact from the prospect. 

Personal data collected and processed in connection with applications sent via the Recruitment Website is kept in accordance with the procedures described below:

  • Concerning candidates selected and hired by Fidal

Your personal data is kept in an active database for the duration of the recruitment process, until you are hired. Once you have been hired, this data may be reused and kept for personnel management purposes. Fidal will keep in an intermediate database (archiving) only information that is strictly necessary for evidentiary purposes. 

  • Concerning unsuccessful candidates:

Your personal data will be kept in an active database for three (3) months after the recruitment process has been completed, in particular in order to be able to explain to you the reasons for our decision. 

If you consent, we may keep your data in order to contact you again in the event of new opportunities. In such case, the length of time we keep your data will depend on the type of position concerned and will in no event exceed two (2) years from the date of our last contact. You may object, without justification, to such retention of your data. At the end of this two-year period, we may ask you to consent again to having your data kept for a reasonable period of time, up to a maximum of two (2) years. 

Your personal data will be kept in an intermediate database for up to 5 years from the completion of the recruitment process, in particular for evidentiary purposes. 

  1. Is my personal data secure? 

We are committed to preserving the confidentiality, integrity, availability and security of your personal data. In accordance with the Regulations, we endeavor to implement the appropriate technical and organizational measures to guarantee the level of security best suited to the risks involved in processing your personal data. We also take steps to prevent, as far as possible, any loss, accidental destruction, alteration or unauthorized access to your personal data.

  1. What rights do I have over my personal data? 

In accordance with the Regulations, you have: 

  • A right to access and rectify your personal data;
  • A right to object to the processing of your personal data for legitimate reasons;
  • In the cases provided for by law, the right to request that the processing of your personal data be limited and/or that said data be deleted;
  • A right to request the portability of your personal data, for your own use or for transmission to a third party of your choice;
  • The right to withdraw, at any time, your consent, where such consent is the basis for the processing of your personal data.

You also have the right to lodge a complaint with a supervisory authority, such as the Commission Nationale de l'Informatique et des Libertés (CNIL).
